Terms & Conditions

1. Who we are and when these terms apply

1.1 In these terms, "we", "us" and "our" means Wild and Seek Pty Ltd (ACN 634 832 527) as trustee for the McKeen Unit Trust (ABN 15 312 283 032), trading as Wild and Seek. "You" means the person who makes the booking and everyone staying with them.

1.2 These terms apply to every stay at Wild and Seek, 326 Gorricks Run, Upper Macdonald NSW (the Property), including the Tiny House, the Cabin, the Cottage and the Retreat, and to any extras such as the Wellness Session.

1.3 If you book through our website, you accept these terms by ticking the box at checkout. If you book through a third-party platform such as Airbnb or Riparide, that platform's payment and cancellation terms apply to your booking, and sections 3 to 8 of these terms (your stay, safety, liability, the Wellness Session, damage and fees) also apply to your stay.

1.4 Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or changed.

2. Bookings, payment and cancellations

2.1 The person making the booking must be 18 or older and must stay at the Property for the whole booking. Guests under 18 must be supervised by an adult at all times.

2.2 Each stay has a maximum number of guests, shown on the booking page. Only the guests named in your booking may stay overnight.

2.7 Bookings through Airbnb or Riparide are cancelled and refunded under that platform's policy, not clause 2.4.

3. Arrival and your stay

3.1 About 7 days before you arrive, we will email "Your Guide to the Wilderness" with directions, access details and what to bring. Further house rules are in the welcome binder in your accommodation.

3.2 Check-in and check-out times for each stay are shown on the booking page and in your guide.

3.3 Driving and parking. Use only the marked route to and from your accommodation, and park only in the marked area (maximum 2 cars per booking). Unsealed roads can become slippery and boggy; you are responsible for any towing or damage if you leave the marked route or ignore wet-weather parking.

3.4 House rules. During your stay you agree to:

  • stay within your accommodation area and the shared areas described in your guide, and not enter other dwellings or areas marked private
  • not remove or damage plants, and not approach, feed or harm any animals, wild or domestic
  • keep fires to the fire pits provided, below knee height, and never leave them unattended; follow any fire ban we notify you of by text
  • bring pets only to stays marked pet-friendly, and keep them under control
  • leave gates as you find them
  • keep noise down, especially between 10pm and 8am
  • not hold parties or events
  • not smoke or vape inside any building or within 10 m of any accommodation, and take your butts with you
  • use the composting toilet as instructed in your accommodation
  • follow the rules in the welcome binder and on signs around the Property

3.5 If you seriously or repeatedly break these rules, or bring more guests than booked, we may ask you to leave. If we do, we will refund any unused nights only where the law requires it.

3.6 In an emergency, call 000. Emergency details, the nearest hospital and the Property address are in your welcome binder.

4. Risks on the Property

4.1 Wild and Seek is an off-grid property on 40 acres of bushland, surrounded by national park. Staying here involves risks that are not present in a city hotel. By booking, you confirm you have read and understood the risk warnings below, and you agree to take reasonable care for your own safety and the safety of everyone in your party.

4.2 Risk warnings:

Risk

What it means for you

Uneven ground and walking trails

Paths and trails are natural and uneven, with rocks, roots, slopes and loose ground. Wear suitable footwear and use a torch at night.

Creek and water

The creek is natural and unsupervised. Depth, flow and water quality change, especially after rain. Never swim alone or after drinking alcohol, and supervise children at all times.

Wildlife

Snakes, spiders, ticks, kangaroos, wild pigs and other animals live on the Property. Keep your distance, watch where you step, and keep food stored.

Fire

Fire pits, the wood-fired sauna and the wood-fired bath involve open flame and hot surfaces. Supervise children, never leave a fire unattended, and follow fire bans.

Weather and bushfire

Storms, heat, flooding and bushfire can occur. Follow any instruction from us or emergency services, and check the Hazards Near Me NSW app.

Remote location

The Property is remote, with limited mobile coverage in places. Emergency services may take longer to arrive.

Unsealed roads

Access roads are unsealed and can be slippery, boggy or damaged after rain. Drive slowly and to conditions.

Decks, lofts and ladders

Lofts are reached by ladder or stairs and decks have drops. Take care, especially at night or after drinking alcohol, and supervise children.

5. Liability

5.1 We take care to keep the Property safe and maintain it regularly. If something at the Property is unsafe or not working, please tell us straight away.

5.2 Your rights under the Australian Consumer Law are not affected by these terms (see clause 1.4).

5.3 To the extent permitted by law, we are not responsible for:

  • injury, loss or damage caused by you or anyone in your party, including by ignoring these terms, the risk warnings in section 4, or instructions from us
  • loss of or damage to your belongings, vehicles or pets, unless caused by our negligence
  • any indirect or consequential loss, such as lost wages or travel costs, unless the law says otherwise

5.4 You are responsible for loss or damage to the Property, the accommodation or our equipment caused by you, anyone in your party, or your pets, beyond fair wear and tear (see section 7).

5.5 Where the law allows us to limit our liability for failing to meet a consumer guarantee, our liability is limited to supplying the services again or refunding the cost of the affected part of your booking.

5.6 We hold public liability insurance.

6. Wellness Session terms and waiver

Every adult using the Wellness Session must accept this section before the session, by ticking the box when booking online or by signing or replying to the waiver we send.ย

6.1 The Wellness Session gives private use of the wood-fired sauna, cold plunge baths, outdoor shower and outdoor gym for a 6-hour session (6amโ€“1pm or 2pmโ€“9pm). It costs $200 per session and must be paid in full when booked.

6.2 Health warnings. Saunas, cold plunges and exercise put stress on the body. Do not use the sauna or plunge baths, or check with your doctor first, if you:

  • are pregnant
  • have a heart condition, high or low blood pressure, epilepsy or a respiratory condition
  • are taking medication that affects heart rate, blood pressure or temperature
  • have recently had surgery, an injury or an illness

6.3 Safety rules. During your session you agree to:

  • not use the sauna or plunge baths after drinking alcohol or taking drugs
  • drink plenty of water and leave the sauna straight away if you feel dizzy, faint or unwell
  • limit time in the sauna to 15 minutes at a time and in the cold plunge to 3 minutes at a time
  • enter the plunge baths slowly and never put your head under the water
  • follow our safety advice: we recommend never using the sauna alone
  • not let anyone under 18 use the sauna, plunge baths or gym, and supervise all children in the area
  • check gym equipment before use, use it only for its intended purpose, and stop if it appears damaged
  • not add fuel to the sauna fire or adjust the stove except as shown in The Sauna Guide
  • follow The Sauna Guide and all signs in the wellness area

6.4 Recreational services waiver. The Wellness Session (including the sauna, plunge baths, outdoor shower and outdoor gym) is a recreational service within the meaning of section 139A of the Competition and Consumer Act 2010 (Cth).

To the extent permitted by section 139A of the Competition and Consumer Act 2010 (Cth), and despite any other provision of these terms, we exclude all liability for any failure to comply with a consumer guarantee under sections 60, 61 or 62 of the Australian Consumer Law in relation to the supply of the Wellness Session, to the extent that liability is for:

  • death
  • physical or mental injury (including the aggravation, acceleration or recurrence of an injury)
  • the contraction, aggravation or acceleration of a disease

This exclusion does not apply to significant personal injury caused by our reckless conduct, as those terms are defined in section 139A of the Competition and Consumer Act 2010 (Cth).

6.5 Cancellations. You can cancel or move a Wellness Session for a full refund up to 24 hours before it starts. If we cancel a session (for example, because of a fire ban or unsafe weather), we will refund it in full or move it to another time, at your choice.

6.6 Acknowledgement:

"I have read the health warnings, safety rules and recreational services waiver above. I understand the risks of using a sauna, cold plunge baths and outdoor gym, and I agree to these terms."
